This article examines the notion of gender neutrality in rape, its meaning and why rape definitions that include females and males as potential victims of rape have become influential in those jurisdictions that have engaged in significant levels of rape law reform over the last four decades. In so doing, several of Annabelle Mooney’s criticisms of gender neutral rape laws, published in an earlier article, will be critically examined. The second part of this article draws on themes that have been (...) identified in the linguistic analysis of rape trials involving female complainants and applies those themes to two cases of rape and sexual assault involving male complainants. Finally, this article examines whether the tactics used by defence lawyers during cross-examination can be said to be uniquely ‘gendered’ or whether similar tactics exist in cases of male rape and sexual assault. Explanations for possible similarities in treatment are also examined. (shrink)

Nietzsche wrote that he owed his philosophy to his long sickness, which he called “the teacher of great suspicion”. The present paper considers the related ideas of the will to power and the eternal return in the light of Nietzsche’s concepts of sickness and health. This reading of Nietzsche’s works is guided by the interpretations of Gilles Deleuze and Pierre Klossowski, whose commentaries have been most influential in shaping French neo-Nietzscheanism since 1965; however, those passages literally or metaphorically employing the (...) language of physical and mental illness and health are emphasized. After introducing the key concepts of will, force, affirmation, and self, the paper develops the idea of active and reactive forces, presents the eternal return as a selective doctrine, and considers the meaning of arnor fati. It closes with remarks, based upon Nietzsche’s views, on the interpretation of philosophical texts and on the relationship between the philosopher’s life and works. (shrink)

Using data from the 1993 Consumer Expenditure Survey to examine housework-related service consumption, the author finds that spending on housekeeping services and meals out—which helps relieve women's housework burden—is affected by dynamics within marriages as well as by family class and race-ethnicity. Other things equal, families in which women have more relative power, as reflected in their income and occupational status, consume more housekeeping services and spend more of their food dollars on meals out, as do wealthier families and white (...) families. Along with housework itself, which is well studied, these results suggest that housework service consumption is also an arena for gendered negotiation and conflict within families, and one way that gender relations vary by class and race-ethnicity. We describe a dual-process theory of how individuals estimate the probabilities of unique events, such as Hillary Clinton becoming U.S. President. It postulates that uncertainty is a guide to improbability. In its computer implementation, an intuitive system 1 simulates evidence in mental models and forms analog non-numerical representations of the magnitude of degrees of belief. This system has minimal computational power and combines evidence using a small repertoire of primitive operations. It resolves the uncertainty of divergent evidence for single events, (...) for conjunctions of events, and for inclusive disjunctions of events, by taking a primitive average of non-numerical probabilities. It computes conditional probabilities in a tractable way, treating the given event as evidence that may be relevant to the probability of the dependent event. A deliberative system 2 maps the resulting representations into numerical probabilities. With access to working memory, it carries out arithmetical operations in combining numerical estimates. Experiments corroborated the theory's predictions. Participants concurred in estimates of real possibilities. They violated the complete joint probability distribution in the predicted ways, when they made estimates about conjunctions: P, P, P, disjunctions: P, P, P, and conditional probabilities P, P, P. They were faster to estimate the probabilities of compound propositions when they had already estimated the probabilities of each of their components. This article explores the effect of women’s movement into the labor market on the gender segregation of work, using the Current Population Survey from 1972 to 1993. The author includes as working those respondents who were “keeping house” and codes keeping house as an occupation. The results show higher estimates of gender segregation, and slightly steeper declines over time, than were seen in previous studies. Analysis of one-year longitudinal changes reveals less movement out of female-dominated occupations when keeping house is (...) included as an occupation. Finally, a decomposition of the segregation trend shows that the movement of women away from keeping house contributed as much to the overall decline in gender segregation as did the desegregation of paid occupations. The author concludes that the movement of women’s work from the household to the labor market has been a driving force in the changing nature of gender inequality. (shrink)

This article presents a fundamental advance in the theory of mental models as an explanation of reasoning about facts, possibilities, and probabilities. It postulates that the meanings of compound assertions, such as conditionals (if) and disjunctions (or), unlike those in logic, refer to conjunctions of epistemic possibilities that hold in default of information to the contrary. Various factors such as general knowledge can modulate these interpretations. New information can always override sentential inferences; that is, reasoning in daily life is defeasible (...) (or nonmonotonic). The theory is a dual process one: It distinguishes between intuitive inferences (based on system 1) and deliberative inferences (based on system 2). The article describes a computer implementation of the theory, including its two systems of reasoning, and it shows how the program simulates crucial predictions that evidence corroborates. It concludes with a discussion of how the theory contrasts with those based on logic or on probabilities. (shrink)

This paper reports three studies of temporal reasoning. A problem of the following sort, where the letters denote common everyday events: A happens before B. C happens before B. D happens while B. E happens while C. What is the relation between D and EEfficacylls for at least two alternative models to be constructed in order to give the right answer for the right reason. However, the first premise is irrelevant to this answer, and so if reasoners were to ignore (...) it, then they would need to construct only one model. Experiment 1 showed that one-model problems were answered faster and more accurately than multiple-model problems. When the question preceded the premises in the statement of the multiple-model problems there was a slight tendency for the latencies of response to speed up in the predicted way. Experiment 2 modified the procedure, in part by using practice problems with many irrelevant premises, so that reasoners might grasp the advantage of ignoring them. Its results showed that when the premises preceded the question, the multiple-model problems were significantly harder than one-model problems. But when the question was presented first, the difference was significantly reduced in line with the theory's prediction. Experiment 3 used only problems with valid conclusions, and so the construction of multiple models was never necessary. However, there was still a significant difference between one-model problems and multiple-model problems. (shrink)

This paper replies to Politzer’s (2007) criticisms of the mental model theory of conditionals. It argues that the theory provides a correct account of negation of conditionals, that it does not provide a truth-functional account of their meaning, though it predicts that certain interpretations of conditionals yield acceptable versions of the ‘paradoxes’ of material implication, and that it postulates three main strategies for estimating the probabilities of conditionals.

The theory of mental models postulates that meaning and knowledge can modulate the interpretation of conditionals. The theory's computer implementation implied that certain conditionals should be true or false without the need for evidence. Three experiments corroborated this prediction. In Experiment 1, nearly 500 participants evaluated 24 conditionals as true or false, and they justified their judgments by completing sentences of the form, It is impossible that A and ___ appropriately. In Experiment 2, participants evaluated 16 conditionals and provided their (...) own justifications, which tended to be explanations rather than logical justifications. In Experiment 3, the participants also evaluated as possible or impossible each of the four cases in the partitions of 16 conditionals: A and C, A and not-C, not-A and C, not-A and not-C. These evaluations corroborated the model theory. We consider the implications of these results for theories of reasoning based on logic, probabilistic logic, and suppositions. (shrink)

This volume presents the long-awaited edition of the Cave 4 manuscripts of Serekh Ha-Yahad or The Rule of the Community, in which the Essenes detailed the guidelines for membership in their community. Also known as the Manual of Discipline, a complete scroll was found in Cave 1 at Qumran and this edition illuminates the textual and redactional history of Dead Sea literature. The document is extremely important for understanding the nature, practice, and ideology of the Qumran covenanters.

We estimate that 208,000 deep brain stimulation (DBS) devices have been implanted to address neurological and neuropsychiatric disorders worldwide. DBS Think Tank presenters pooled data and determined that DBS expanded in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. The DBS Think Tank was founded in 2012 providing a space where clinicians, engineers, researchers from industry and academia discuss current and emerging DBS technologies and logistical and ethical issues facing the field. (...) The emphasis is on cutting edge research and collaboration aimed to advance the DBS field. The Eighth Annual DBS Think Tank was held virtually on September 1 and 2, 2020 (Zoom Video Communications) due to restrictions related to the COVID-19 pandemic. The meeting focused on advances in: (1) optogenetics as a tool for comprehending neurobiology of diseases and on optogenetically-inspired DBS, (2) cutting edge of emerging DBS technologies, (3) ethical issues affecting DBS research and access to care, (4) neuromodulatory approaches for depression, (5) advancing novel hardware, software and imaging methodologies, (6) use of neurophysiological signals in adaptive neurostimulation, and (7) use of more advanced technologies to improve DBS clinical outcomes. There were 178 attendees who participated in a DBS Think Tank survey, which revealed the expansion of DBS into several indications such as obesity, post-traumatic stress disorder, addiction and Alzheimer’s disease. DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded in (...) its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. The role of followers in financial statement fraud has not been widely examined, even though these frauds typically involve collusion between followers and destructive leaders. In a study with 140 MBA students in the role of followers, we examined whether two follower personality traits were associated with behavioral intentions to comply with the demands of an unethical chief executive officer to be complicit in committing financial statement fraud. These personality traits are self-sacrificing self-enhancement, a form of maladaptive narcissism characterized by (...) seemingly altruistic behaviors that are actually intended to boost self-esteem and proactivity, a trait characterized by behaviors reflecting efforts to positively change one’s environment. As predicted, follower SSSE was positively associated with follower behavioral intentions to comply with CEO pressure to commit fraud, while follower proactivity was negatively associated with fraud compliance intentions. Also as predicted, follower SSSE interacted with follower proactivity, such that followers high in SSSE and high in proactivity reported greater intentions to resist pressure from the unethical CEO to commit fraud compared to low-SSSE followers. Implications for future research and corporate governance are discussed. (shrink)

Introduction No consent for health and medical research is appropriate when the criteria for a waiver of consent are met, yet some ethics committees and data custodians still require informed consent. Methods A single-blind parallel-group randomised controlled trial: 1129 families of children born at a South Australian hospital were sent information explaining data linkage of childhood immunisation and hospital records for vaccine safety surveillance with 4 weeks to opt in or opt out by reply form, telephone or email. A subsequent (...) telephone interview gauged the intent of 1026 parents (91%) in relation to their actions and the sociodemographic differences between participants and non-participants in each arm. Results The participation rate was 21% (n=120/564) in the opt-in arm and 96% (n=540/565) in the opt-out arm (χ2 (1 df) = 567.7, p<0.001). Participants in the opt-in arm were more likely than non-participants to be older, married/de facto, university educated and of higher socioeconomic status. Participants in the opt-out arm were similar to non-participants, except men were more likely to opt out. Substantial proportions did not receive, understand or properly consider study invitations, and opting in or opting out behaviour was often at odds with parents' stated underlying intentions. Conclusions The opt-in approach resulted in low participation and a biased sample that would render any subsequent data linkage unfeasible, while the opt-out approach achieved high participation and a representative sample. The waiver of consent afforded under current privacy regulations for data linkage studies meeting all appropriate criteria should be granted by ethics committees, and supported by data custodians. B. ably notes the constant verbal reminiscences of Herodotus, Thucydides, and Xenophon, especially in the more elaborate passages, e.g., the speeches at the Hyphasis. Still more are undoubtedly to be found, such as the echo of Thucydides (1.110.1, 3.112.8, 87.87.6) in 5.27.6, ¹l¼goi ¨k poll©n. His elucidation of Arrian’s use of Megasthenes, Nearchus, and Eratosthenes in the digressions at the beginning of book 5 is a model of clarity and precision. We review studies of an evolution operator ℒ for a discrete Langevin equation with a strongly hyperbolic classical dynamics and a Gaussian noise. The leading eigenvalue of ℒ yields a physically measurable property of the dynamical system, the escape rate from the repeller. The spectrum of the evolution operator ℒ in the weak noise limit can be computed in several ways. A method using a local matrix representation of the operator allows to push the corrections to the escape rate up (...) to order eight in the noise expansion parameter. These corrections then appear to form a divergent series. Actually, via a cumulant expansion, they relate to analogous divergent series for other quantities, the traces of the evolution operators ℒn. Using an integral representation of the evolution operator ℒ, we then investigate the high order corrections to the latter traces. Their asymptotic behavior is found to be controlled by sub-dominant saddle points previously neglected in the perturbative expansion, and to be ultimately described by a kind of trace formula. The concept of truth is at the core of science, journalism, law, and many other pillars of modern society. Yet, given the imprecision of natural language, deciding what information should count as true is no easy task, even with access to the ground truth. How do people decide whether a given claim of fact qualifies as true or false? Across two studies (N = 1181; 16,248 observations), participants saw claims of fact alongside the ground truth about those claims. Participants classified (...) each claim as true or false. Although participants knew precisely how accurate the claims were, participants classified claims as false more often when they judged the information source to be intending to deceive (versus inform) their audience, and classified claims as true more often when they judged the information source to be intending to provide an approximate (versus precise) account. These results suggest that, even if people have access to the same set of facts, they might disagree about the truth of claims if they attribute discrepant intentions to information sources. Such findings may shed light on the robust and persistent disagreements over claims of fact that have arisen in the “post-truth era”. (shrink)

The process by which auditors consider fraud risk in assessing management’s motivation and character remains under-addressed. This is problematic given the rising tide of narcissism, as well as recent research documenting that both self- and other-perceptions of narcissism influence an array of judgments. While a skeptical attitude is fundamental to the auditor’s gatekeeper role, it remains unclear how auditors form and act on perceptions of client narcissism. With a large sample of experienced accountants as participants, we leverage insights from current (...) narcissism and perceiver effects research to predict (and find) that auditor skepticism responds in a divergent manner to both the auditor’s (1) own antagonistic versus agentic narcissism and (2) perceptions of the client’s antagonistic and agentic narcissism. We discuss the observed opposing behavioral externalities related to these distinct forms of grandiose narcissism, particularly in dynamic interactions between clients and auditors. (shrink)

Par l'engagement social et la lutte politique, il vise désormais un monde où l'éthique n'est plus bloquée dans la mauvaise foi, mais sera « la praxis dans son libre développement comme seule relation éthique de l'homme à l'homme en (...) tant qu'ils dominent ensemble la matière ». Toutefois, si l'on interroge le sens et la possibilité de ce « règne humain » qui structure l'ouvrage, ce qui est en jeu c'est l'ambiguïté de toute la démarche morale de Sartre à partir de son ontologies Là, en effet, le « manque » qui définit le pour-soi aboutit à faire de tout projet un échec puisqu'il n'a de sens que par rapport à une totalité manquée: le projet d'être Dieu. Cet article discute l’analyse en termes de DP qui domine actuellement dans la grammaire générative chomskienne, à savoir, l’idée que la tête du groupe nominal est le déterminant, plutôt que le nom. Nous commençons par une discussion des notions de tête et de dépendance et passons en revue différents critères classiques permettant de décider quel élément est la tête dans une construction donnée. Sur base de ceux-ci, nous proposons une série d’arguments suggérant que la position classique est en réalité la (...) bonne et que c’est bien le nom qui est la tête du groupe nominal. Nous étudions ensuite une série d’arguments et d’analyses spécifiques qui ont été avancés en faveur de l’analyse en termes de DP et montrons pourquoi nous ne les considérons pas comme convaincants. En conclusion, nous notons que le choix entre les analyses NP et DP n’est peut-être pas une question empiriquement décidable si l’on s’autorise les représentations syntaxiques très abstraites qui sont actuellement en vogue dans le cadre de la linguistique générative chomskienne. In this age of DNA computers and artificial intelligence, information is becoming disembodied even as the "bodies" that once carried it vanish into virtuality. While some marvel at these changes, envisioning consciousness downloaded into a computer or humans "beamed" _Star Trek_-style, others view them with horror, seeing monsters brooding in the machines. In _How We Became Posthuman,_ N. Katherine Hayles separates hype from fact, investigating the fate of embodiment in an information age. Hayles relates three interwoven stories: how information lost (...) its body, that is, how it came to be conceptualized as an entity separate from the material forms that carry it; the cultural and technological construction of the cyborg; and the dismantling of the liberal humanist "subject" in cybernetic discourse, along with the emergence of the "posthuman." Ranging widely across the history of technology, cultural studies, and literary criticism, Hayles shows what had to be erased, forgotten, and elided to conceive of information as a disembodied entity. Thus she moves from the post-World War II Macy Conferences on cybernetics to the 1952 novel _Limbo_ by cybernetics aficionado Bernard Wolfe; from the concept of self-making to Philip K. Dick's literary explorations of hallucination and reality; and from artificial life to postmodern novels exploring the implications of seeing humans as cybernetic systems. Although becoming posthuman can be nightmarish, Hayles shows how it can also be liberating. From the birth of cybernetics to artificial life, _How We Became Posthuman_ provides an indispensable account of how we arrived in our virtual age, and of where we might go from here. (shrink)

Are judgments of praise for moral behavior modulated by knowledge of an agent's past suffering at the hands of others, and if so, in what direction? Drawing on multiple lines of research in experimental social psychology, we identify three hypotheses about the psychology of praise — typecasting, handicapping, and non-historicism — each of which supports a different answer to the question above. Typecasting predicts that information about past suffering will augment perceived patiency and thereby diminish perceived agency, making altruistic actions (...) seem less praiseworthy; handicapping predicts that this information will make altruistic actions seem more effortful, and hence more praiseworthy; and non-historicism predicts that judgments of praise will be insensitive to information about an agent's experiential history. We report the results of two studies suggesting that altruistic behavior tends to attract more praise when the experiential history of the agent involves coping with adversity in childhood rather than enjoying prosperity (Study 1, N = 348, p = .03, d = 0.45; Study 2, N = 400, p = .02, d = 0.39), as well as the results of a third study suggesting that altruistic behavior tends to be evaluated more favorably when the experiential history of the agent includes coping with adversity than in the absence of information about the agent's past experience (N = 226, p = .002). This pattern of results, we argue, is more consistent with handicapping than typecasting or non-historicism. (shrink)

The first attempt to represent the Periodic system graphically was the Telluric Helix presented in 1862 by Alexandre-Emile Béguyer de Chancourtois, in which the sequence of elements was wound round a cylinder. This has hardly been attempted since, because the intervals between periodic returns vary in length from 2 to 32 elements, but Charles Janet presented a model wound round four nested cylinders. The rows in Janet’s table are defined by a constant sum of the first two quantum numbers, n (...) and l, so that they end with the s-block, headed by hydrogen and helium. By combining Janet’s table, Edward Mazurs’ version, in which each row represents an electron shell and Valery Tsimmerman’s use of a half square for each element, I have produced a representation that can be printed out and wound round to make a cylinder with manageable dimensions. In the unwound version, I have placed the s-block in the middle, to emphasise its pivotal nature, since it both ends each row and contributes electrons to the valence of elements in the next row; it thus does not necessarily belong either on the left or the right side of a table. The downward arrows that link subshells within each series graphically illustrate the Janet Effect. Recent research suggests that moral behavior attracts more praise, and immoral behavior less blame, when the agent has suffered in childhood. In this paper we report results from three studies in which a fictional character’s childhood was described in terms of either neglect and abuse (Adversity condition), love and care (Prosperity condition), or neutrally (Control condition). In Study 1 (N = 248), participants in the Adversity condition attributed more praise to a fictional character relative to other conditions. In Study 2 (...) (N = 275), participants in the Adversity condition attributed more praise and less blame relative to other conditions, with the effects mediated by self-expressivity. In Study 3 (N = 275), where the character was female rather than male, there was no effect of condition on praise, but there was an effect of condition on blame, and this effect was mediated by self-expressivity and social-emotional impairment. There are some issues, and bilingualism is one of them, that have been mainstays in the scholarly dialogue of classicists and historical linguists for centuries. This interest has (...) been fueled in part by the frequent references to Greek/Latin bilingualism in the ancient record, especially in connection with what Adams (Bilingualism and the Latin Language, 9) calls "élite bilinguals," i.e., upper-class Romans who were skilled in Greek. For example, Quintilian (1.1.12) says: "a sermone Graeco puerum incipere malo, quia Latinum, qui pluribus in usu est, vel nobis nolentibus perbibet." Cicero (Verr. 4.127), attacking Verres for his lack of cultivation, has the following harsh words: "tum epigramma Graecum pernobile incisum est in basi, quod iste eruditus homo et Graeculus, qui haec subtiliter iudicat, qui solus intellegit, si unam litteram Graecam scisset, certe non sustulisset." There is a notable passage in Gellius (17.17.1; commentary by Skutsch, The Annals of Q. Ennius, Oxford 1975, 749-50) in which he affirms the proficiency of Ennius in Greek, Latin and Oscan, and that of the famed king Mithridates, who was said to be fluent in twenty-five different languages ("Quintus Ennius tria corda habere sese dicebat, quod loqui Graece et Osce et Latine sciret. Mithridates autem... quinque et viginti gentium quas sub dicione habuit linguas percalluit").But as is the case with many everyday commonsense notions, bilingualism is far more complex, and far more interesting, than has been thought previously. Bilingual societies have to some extent been unappreciated and have certainly been underanalyzed by scholars of the ancient world. The reasons are obvious but merit restatement: although bilingualism in ancient societies was an everyday fact of life, most of them did not have "language policies" governing the use of languages in particular social settings and therefore offer no scholarly or administrative discourse on the matter. Furthermore, the study of ancient bilingualism depends crucially on the existence of certain kinds of (bilingual) materials, a knowledge of the languages in question (not only Greek and Latin), and on subtle sociolinguistic notions, which are generally not in the repertoire of the literary or historical scholar, or the historical linguist.But this is all beginning to change, as scholars of antiquity begin to discover the features—psychological, sociological, and linguistic—that defined bilingual societies. Ashley's essay concludes with an apology for any unintended (...) offense resulting from imprecise or otherwise infelicitous expressions of his position; and he suggests that such lapses on the part of the CDF letter itself were " inevitable in a document that had to he brief and directly to the point in order to clear up the ambiguities with which this complex question has been obscured" (p. 109). My personal assessment is that Ashley has succeeded much better than CDF in minimizing such problems; he might have been even more successful had he not been so intent on downplaying or excusing the letter's undeniable faults in this regard. Of course, Ashley is here engaging in debate with the Vatican's critics; were he instead directly addressing CDF, his approach might well have been different. Even in the present context, however, as a better gesture toward gay and lesbian people wounded by the letter's simplistic and harsh prescriptions, it would have been well for Ashley to repeat the observation he once addressed to U.S. and Canadian bishops assembled in Dallas for a sexuality workshop (Feb. 2-6, 1981): "Overfacile solutions to the tragic dilemmas of life which people are experiencing make the Church appear smug and silly." The debate over this issue will continue, as indeed it must. The participants in this hook, notwithstanding problems on either side, have contributed significantly to the ongoing conversation and have set a high standard which we must hope will he emulated by all who carry the conversation forward. Edmund Santurri has written an important book about a central issue in moral theory and a fundamental problem in the moral life. On occasion, one feels on the horns of a dilemma. Whatever course of action might he taken, it appears as if wrong will he done in the process of doing right. Thus, we want to keep promises, but if we keep BOOK REVIEWS 165 this promise, we will cause or allow some great harm to come to an· other person. How ought this sort of dilemma to he understood? Santurri argues that there are within the traditions of moral philosophy and theology two ways of construing the problem. One can say either that moral dilemmas of the sort Santurri discusses are the re· sult of deficient knowledge and so in principle resolvable, or that they stem from the structure of the moral universe itself and are in consequence not resolvable. It is Santurri's contention that Christian ethics must hold to the former position and defend the view that in all dilemmatic contexts there is a way to dispel moral perplexity through more adequate moral knowledge. In order to establish this thesis he undertakes a review of typical philosophical and theological literature that addresses the problem he has identified. Santurri's review of the philosophical literature, though on occasion unnecessarily dense, is always competent and generally thorough. Among others, he reviews the work of David Lyons, Bernard Williams, and Thomas Nagel. His conclusion is that philosophical argument can establish neither of the two possible views of moral dilemma as superior to the other. Arguments designed to establish both points of view prove inconclusive in the end because they beg more fundamental ques· tions concerning the content, nature, and function of morality itself. Thus, Santurri argues that moral perplexity cannot he interpreted adequately apart from a discussion of " certain fundamental questions of moral ontology " (p. 4), and he quite successfully shows that these questions are passed over or inadequately treated in the philosophical literature.
